A Study on the Reform Strategies of the Temporary Incapacity Benefit in the Industrial Accident Compensation Insurance

본 연구는 우리나라 산재보험제도 휴업급여의 기능적 특성과 운영상의 문제점을 살펴보고, 이에 대한 개선대안을 제시하고자 하는데 목적을 두고 있다. 이 글에서 제시한 휴업급여의 개선대안을 행정적 절차의 구분에 따라 정리해보면 다음과 같다. 먼저 휴업급여 신청단계에서의 개선대안으로서 보험급여의 수급자격에 대한 전문적 심사가 이루어질 수 있는 제도적 기반을 구축하고, 아울러 부적절한 재요양의 신청을 억제하기 위하여 재요양 직전의 근로소득을 기준으로 휴업급여를 산정할 것을 제안하였다. 다음으로 휴업급여의 장기체류 유인을 방지하기 위한 개선방안과 관련한 사항이다. 첫째, 단기성 급여로서의 취지에 부합될 수 있도록 휴업급여의 지급기간은 2년으로 제한하고, 이를 위한 선행요건으로서 현행의 장해연금을 임시장해연금과 영구장해연금으로 분리 운영할 것을 제안하였다. 둘째, 요양기간 동안 취업활동을 허용하고 이 경우 부분휴업급여가 제공이 될 수 있도록 하는 방안을 제안하였다. 셋째, 휴업급여에 대한 의존성 극복과 경제적 자립을 유도하기 위하여 직업재활과 직업알선의 기능을 활성화하고 동시에 요양종결이나 직업재활에 대한 공단의 직권결정을 강화할 것을 제안하였다.
This study examined the functional characteristics and procedures of temporary incapacity benefit of industrial accident compensation insurance and suggests its policy measures against their problems. Presently the temporary incapacity benefit is the focus of attention for expanding the finance of industrial accident compensation insurance.
Policy measures against these problems are constructed according to the administrative levels. The precise scrutinization is requested for qualification at application level, and the estimation of benefit amount should be based on the earned income right before reentry of incapacity to suppress over application. The followings are policy measures to prevent prolongation of temporary incapacity benefit.
First, the duration of benefit must be limited up to 2 years and it is prerequisite for the separation of the present disability pension into temporary disability pension and permanent disability pension.
Second, it allows the beneficiary to get a job during the incapacity period and will be supported by partial incapacity benefit.
Third, to prevent over application and to give work incentive, this study suggested the rearrangement of the duplicated benefits from both the national pension and the industrial accident compensation insurance.
