본 연구의 목적은 수사부터 기소, 재판까지 형사사법 절차의 과정에서 장애인피의자들이 비장애인들보다 더 많은 인권침해와 차별을 당하고 있다는 문제인식하에, 각 단계별로 어떤 차별실태가 있는지를 조사하여, 비장애인에 비해 형사상 더 많은 어려움을 겪고 있는 장애인들의 인권을 보호하고 증진할 수 있는 방안을 논의해 봄으로써 장애인차별금지법이 개정되어야 할 방향성에 대한 함의를 제공하고자 한다.
본 연구에 나타난 주요결과로 장애인 피의자들은 의사소통에 어려움을 겪고 있으며, 경찰이나 검찰의 장애인에 대한 이해와 인식이 부족하여 차별을 경험하는 경우가 많고, 장애인 피의자들은 법률적 정보를 제공해 줄 대상이 없어 대부분 국선변호인에게 변호를 맡기게 되는데 국선변호인들은 불성실하게 변호하는 경우가 많았다. 특히 형사사법기관의 종사자 면접결과 형사사법기관 지휘부의 무관심과 이로 인한 행정적？법적지원의 부족, 그리고 형사사법기관종사자들에 대한 인권교육 미비로 인한 차별적 태도가 장애인 피의자의 차별을 지속하게 하는 원인으로 나타났다.
연구결과를 바탕으로 형사사법 기관 종사자의 장애인에 대한 이해 및 의식전환이 필요하며 이를 위한 장애인 인권교육을 제도화해야 하며, 장애인의 수사과정에서 국선변호인을 지정하고 일부 장애유형에 있어서는 적극적으로 변호인의 참여를 의무화하는 것을 검토하고, 형사사법절차상의 장애인 차별금지 및 권리보호 법령체계를 정비할 것 등을 제언하였다.
In Korea, the policy and the law recently has shifted toward protecting human rights of the disabled person. The purpose of this study is to explore the realities of disabled criminal suspects' experience and review the ways which guarantee their human rights. The data has been collected through in-depth interviews. Case study analysis has been used for data analysis.
The research findings revealed that there was no system to protect a criminal suspects' right focusing on a disabled person. Secondly, disabled persons often faced prejudices and discrimination in the criminal investigation process. The police officers and the prosecutors didn't understand disabilities and frequently showed negative attitudes toward people with disabilities.
In conclusion, we have made some practical suggestions for both the police and prosecutors concerning support system for criminal suspects with disabilities.
