초록

최근 『사회보장급여의 이용·제공 및 수급권자 발굴에 관한 법률』이 제정됨에 따라 민간 사회복지 전달체계 구축방향을 모색해야 하는 법적·사회적 요구에 직면하여 사회복지법인 제도의 의미와 사회복지법인의 역할에 대한 논의 필요성이 커지고 있다. 이 글은 공공 전달체계를 체계화하면서 사회서비스 분야에서 민간 전달체계의 핵심이라고 할 수 있는 사회복지법인이 사회서비스 제공형태 및 공급주체의 다양화, 민법 개정과 사회적경제기본법 발의 등 변화하는 환경 속에서 어떻게 변화·발전해야 하는지를 살펴보는데 그 목적이 있다. 사회복지법인은 민간전달체계의 중심적 위치에서 사회서비스를 제공하는데 접근성, 지속성과 책임성 등 공공성을 확보하는 교두보적인 역할을 수행하기 위해서는 장기발전계획의 수립, 전국적 실태조사에 따른 자료의 데이터베이스화 등 기본적인 토대가 갖추어져야 한다. 아울러 사회복지법인 설립요건 완화, 운영의 융통성 확보 및 퇴출구조 방향 정립 등의 정책적·제도적 변화를 모색하여 역할 다변화의 토대를 마련할 필요가 있다. 이러한 기반하에 사회복지법인은 지역사회복지 증진을 위한 민간부문에서의 파트너로서 공공 전달체계와 적극적인 협력을 모색하는 주체성을 담보해 내야 할 것으로 본다.

According to the enactment of 『Act on Reception and Provision of Social Security Provision and Finding Prospecting Welfare Recipients』 recently, social concerns on how to construct delivery system of non-governmental sector. In addition recent changes such as diversity of service providers, service user-oriented provision patterns and external circumstance changes like revision of Civil Law and enactment of Basic Social Economic Act provoked social concerns on the role of social welfare foundation. Basically it is very important to establish long-term development planning and construct database through national survey on social welfare foundation regardless of finding out the prospecting role of social welfare foundation. Policy changes like lowering the strictness on establishment of social welfare foundation and setting direction on securing financial flexibility are required to zoom the role of social welfare foundation. With these preconditions there needs to search the way to utilize basic asset of social welfare foundation on the way to accommodate the role of enhancing the level of community welfare under the partnership with public sectors.
